Legal Question in Family Law in California
Harrassment by ex-husband
My divorce was finalized 4/6/05 & the court mailed my copy of the dissolution to my former address which my ex-husband still maintains. He forwarded the dissolution in another envelope to my place of employment with a post-it note inside inscribed ''you are now officially between husbands.'' We've been apart for 1-1/2 years and I've had problems with him in the past showing up at my son's (not his) Little League games. My attorney at the time sent a demand letter to his former attorney that he stop coming to the games, since he had no children playing there and it was making my son (10) uncomfortable. He continued to come despite his attorney's warnings. My question is regarding laws pertaining to using the USPS to facilitate his harrassment of me. Other than keeping copies of his mailings in the event he increases the level of intensity or the frequency, is there anything I can do to legally require him to stop? I have considered a restraining order, but I was advised by the attorney that I had only a 50/50 chance at getting the judge to sign it, and I just couldn't afford the $300 at the time. Do I have grounds for a restraining order? And, can I file a complaint with the USPS for harrassing me through the mail?

You need to keep a record of these contacts and consider video taping his appearances at your son's activities. The conduct you describe would be sufficient for many judges to issue a temporary restraining order and a permanent restraining order against him. If he had a long relationship with your son that would reduce the possibility of the restraining order being issued.
