Legal Question in Family Law in California

Hello,

I and my husband got divorced in Russia; our Russian custody agreement is not effective in the US. For over 3 years my daughter has lived with her dad, since I was a student and had a part-time job. Now I have got a full-time job, so I would like to rent a room and get my daugther to live with me.

She is 15; she wants to live with me since her dad is very mentally abusive.

Can I just take her to my home without his permission since we do not have any custody agreements in the US?

Try taking her to your home and see what happens. That runs a risk, however, that he could use that against you if he goes to court. You can lodge your agreement with the court and then file an Order to Show Cause for a change of custody.
