Legal Question in Family Law in California
Hello,
I have a problem with my baby's father. He is not picking up our son when he is required to. He did not follow child custody court orders that he filed because of his job so we came to a verbal agreement that he could pick him up when he has his days off every week. Now he is not doing that at all, it has been a month and he's no where to be seen or heard of. But he is sending me threatening text messages because i want to file for full custody so i know he is still alive. Is there any punishment for him violating court orders? What can I do so he doesn't take his son whenever he feels like it? I need help in settling a firm schedule so he takes this serious. I already contacted child support and requested for more money because he is not around anymore. I have police reports stating when he did not pick up our son so i have proof that he did not follow custody orders.

You can have his visitation reduced or modify the current orders. You can't force him to pick him up but he can only pick up the court ordered times or agreed upon times. If he does not pick up it does not necessarily violate court orders especially if you agree to something different.
