Legal Question in Family Law in California
Hello,
Please let me know if California has Consent for Adoption Judicial Council form? I received State of California HEALTH AND HUMAN SERVICES AGENCY (DEPARTMENT OF SOCIAL SERVICES) form from my ex to fill out but I really want to create my owe so I can be more specific with the terms of this consent.
Can I do that? If yes:
1. can I use any terms?
2. can I draft it myself or I need to hire an attorney?
3. In that form it states: "the adoption of your child by a stepparent does not affect the childs right to inherit your property or the property of blood relatives. For further information regarding this right of inheritance, you should consult an attorney." CAN I REMOVE IT and specifically state the child looses his rights of inheritance?
Thank you very much in advance for your help!

DPSS, Monterey park, where they handle the adoptions, if it is an independent adoption, only accepts the HHS form. So, no, you cannot use your own. Actually, by virtue of the adoption, the child should lose their right to inherit as your rights are being severed.
You need to hire an attorney. This is a very serious situation and will effect you, and the child for the rest of your respective lives. Do not proceed without at least consulting an attorney. An initial consultation with an attorney will not cost a lot of money and it will give you the specific information you need for your specific situation. And "no" you may not remove that line from that form. If you do they will not accept the form.
Good luck
