Legal Question in Family Law in California

Hi,

My husband and I want to get divorce. Can I file a summary dissolution? I have no children and married less than 3 years. I do not know if he has any real property. I do not own any. He told me he does not have any. Will the court check to see if he has any Real property (like house)? actually I do not really care whether he owns a house or not....I just want to find the simplest way to get it done

A summary dissolution is appropriate for very short term marriages and essentially no assets and no debts. It should be a simple straightforward process if in fact you want to proceed down that route. You should check out your local law library for self help law books on how to do a summary dissolution. Another option is to check out your local family law facilitator to ask how to do one. You should be sure before you proceed that, there are no community assets you would be entitled to, otherwise you may miss the opportunity to receive the community share of them.
