Legal Question in Family Law in California
Holiday Weekend Dispute
Our custody papers say: ''Whenever such a weekend falls on a 3 day weekend (legal holiday) the child shall be with Petitioner from 6:30 pm on (day after) the last normal (Thursday or Friday) to 7:00 pm on the last day of the holiday weekend before school resumes.'' The such a weekend is referring to my regularly scheduled weekend visits.
My ex states that the Court told them that this means instead of my picking up my son on Friday (tomorrow)like I normally do, I have to pick him up on Saturday at 6:30 pm so that I can have the Holiday Monday with him.
Please help - I'm at a loss since this is sprung on me 24 hours before it's suppose to be my weekend.

Usually the holiday is just "tack onto" the weekend. You get an extra Monday or Friday.

Re: Holiday Weekend Dispute
without seeing the order it would seem unlikely that this is what the court meant. Normally the visitation does not change except that is it extended to include the holiday. Thus on Friday the visitation starts a day early and on Monday the visitation extends into Monday.
