Legal Question in Family Law in California

Home ownership or equity

After a relatonship of 6 years my significant other and I bought a home. It was put in her name due to her credit score. Two years later we married. After another two years my wife has filed for divorce. The first two years of home ownership she wrote the IRS a letter stating we would each split the interest paid as she considered us both owners. Now she claims the home to be all hers. Do I have any rights?

You have a very good legal question and there have been recent cases that revolve around the issues that are raised by your facts. This will probably need to go to a judge to decide after he has considered all of the facts and read the letter that was written to the IRS. You have some rights in the house but you will need an attorney to represent you. Good Luck, Pat McCrary

In a general sense, there is probably a community property interest in and to the real property. The issue as you have presented it is a complex issue that requires more facts and details before an analysis and opinion can be provided.

For a specific opinion regarding your individual circumstances, I suggest that you consult with an experienced family law lawyer. Experience is not expensive, it's priceless!
