Legal Question in Family Law in California
Can a hospital contact police and cps for a patient testing positive drug test?
I collasped at home after taking what I thought was Tylenol Capsual. Then I began having siezures, So my roommate called 911. The ambulance took me and my aloud my son to come in the ambulance to the hospital. I explained what happen, I was still having siezures. They ask me if I did any drugs, I stated no, only the Tylenol Capsuals. They ask me if they could get some urine from me. I stated yes. They took a urine sample and said it was positive for methaphadime. The doctor then yelled at me saying I was doing drugs. I stated once again that I was not. So he said he was going to call the sheriffs. They arrived and questioned me and my son. I told them the same thing I told the doctor. The sheriff was very rude and told me I was a liar. I told him he was welcome to go search my home, because I did not know how this stuff got into my sytem. He said that wasn't necessary he had all the proof he need with the urine test.I had not done any drugs. The doctor gave me some kind of medicine that knock me out. When I woke the next morning, I had a note from a CPS worker stating they had my son in protective care and I was to show up for court on the tenth. I have no criminal record at all. I did not do any drugs.

Doctors and hospital health care workers are required by law to report incidents of possible child abuse or endangerment. You should immediately retain an attorney with juvenile court experience. Then consider having a hair focile test for drugs. This test, although considered by many to be unreliable, is supposed to determine drug test for a period of at least 60 days prior to the test. In the mean time you should consider starting the suggested programs.
