Legal Question in Family Law in California

my house is not in my name

I need a divorce. Recently bought a house in Nv but have residence also in Ca. My husband lives and works in Ca. I have no access to any of our money. My name is not on anything.

I will be married 10 years On may 28th of 2000.

Do I have the rights to my husbands social security then? Just looking for some kind of security. Have been unable to work much during our almost ten years of marriage.

California is a community property state any and all

property obtained during the marriage, regardless

of whose name it's in is split 50/50 between the parties.

As far as Social Security, If you have been married for

ten years you are entitled to your spouses Social

Security once they die even if you are no longer married.

You will be entitled to derivative social security rights if you are married at least 10 years. To assure this, you should not serve him with divorce papers before January 1, 2000. That way you could not be single until June 1, 2000.

I did not see anything about the house not in your name. Issue?

All property obtained during the marriage while you were both living in CA is community property no matter who's name it is in and you will be entitled to half of that too.
