Legal Question in Family Law in California

What about the house?

My husband and I are getting a divorce. We have 2 young boys. He moved out 2 days ago and took the kids without my permission. My lawyer says he can do that because there are no court orders in place yet. Anyway, today, he wrote me a note saying I can have the house and that now I am responsible for paying all the bills because I live there. The house is in HIS name only. What's the deal with that? Can I change the locks on the house now? He keeps entering the house while I'm at work and disturbing things and leaving notes. It's a little frightening. He also told the kids that they are ''not allowed to go home''. Is that legal? Can I just go get them back from him since he is inflicting psychological harm upon them?

Re: What about the house?

You should be asking your attorney these questions. Your attorney has much more knowledge about the facts of your case than you included in your question. You should immediately file a motion to get an order for custody and visitation. As to the question about the house that would depend upon the facts of your case.
