Legal Question in Family Law in California

my husband trying to adopt my son

I have a 4 yr. old son who has never met his biological father and is being raised by my husband and I. His father and I were never married and he moved when he found out I was pregnant and never heard from him again. My husband has been in my son's life since he was one and recognizes him as his father. Now he wants to adopt him and give us his last name but we are not sure if we can do it without the biological father who is not on the birth certificate or any other legal documents. How can we go about doing this?

Start a step parent adoption action with the department of social services. Retaining counsel to assist in the adoption should make the process simpler for you.
