Legal Question in Family Law in California
If my ex husband gives me an affidavit that states he is relinquishing all legal rights to our children including no visitations and no phone calls and would like for me to have sole legal custody and continue to keep having sole physical custody, what are the chances a mediator and/or judge/commissioner will accept this agreement? The catch? I relinquish my rights to child support for now which I did agree to but if I need to retract myself I will. He has violated the court order to which I have evidence through my childrens therapist. It involves child abuse which is why I accepted for him to give me all legal rights in xchange of me not seeking child support. I rather have my children be safe with me and not be around him. My children have expressed they dont want to be around him because they are scared. Within the last 4 years there have been a few child custody court hearings and Iam always awarded primary custodial parent especially since at one point CPS has been involvef and found him to be negligent , manipulative and abusive . Basically I want to know what my chanced are in getting sole legal and sole physical custody. Thank you

Unless he terminates all parental rights, you won't get the no child support to fly...
