Legal Question in Family Law in California

My husband cashed out his retirement and quit his job when we had a fight. He got a separate checking account and linked it with our joint account. Can I get arrested for transferring half of his retirement money into our joint account?

Assuming all of the money from the retirement account is community, you would have a right to secure half of the amount in another account in your name and advise husband of your actions once they've been perfected. Obviously, things are moving very quickly. You should meet with an experienced family law attorney as soon as possible to explore your options.

Another consideration to be mindful of is the tax consequences: if the withdrawal from the retirement account will create a penalty.
