husband has child from affair/ child support community property?

If I am married 20 years and my husband has a child with his girlfriend who sues him for child support, can I request he pays only 50% of our total income? I never have worked outside the home and my husband is very wealthy. Can we ask for only 50% of our monthly income be considered for support on his I & E report?

Child support is calculated by formula and allows for very little variance from the formula, that would not be such a variance. If the income were structured so that you had income from the community companies, then your income would not be part of the calculation. Good Luck, Pat McCrary
