Legal Question in Family Law in California
My husband and i have decided to get a divorce. We got married while he was in a los angeles jail. The very next day he was served with some kind of divorce paperwork from a previous marriage.(he had told me that it was done years ago) I have been told that that qualifys for an annulment but that I need to show proof that he was still married on the date we wed.How would I go about obtaining copy of his marriage & divorce records to prove this?

You should ask him to agree to annull your marriage so that he can get the old divorce taken care of. You can go to the court recorder in the county where he got his license to retrieve a copy of the marriage license. You should consult a local attorney it may be that you do not want a divorce or anullment and want to stay married to him, there may be ways to do that.
For self represented individuals you can consult with the family law facilitator self help center at your local court house.
As always please consult a local attorney prior to taking legal action. Good luck. Also please check out my Santa Clara County Family Lawyer blog.
