Husband does not want me to keep his last name

During my divorce, I was asked if I would like to take back my maiden name or keep my husbands last name. I chose to keep his last name, since we have a a child together that I have full custody of. He said he is going to petition the court, because he does not want me to have his last name. Can he do this, is it legal, and what action can I take against him?

Here's a better idea. If you really want to take them off, instead of using your married name like Jenny Smith, keep calling yourself Mrs. Thomas Smith.

You have a right to keep the name you are using and he will lose if he tries to stop you.
