Legal Question in Family Law in California
My husband and I are divorcing. He is a legal resident alien. One of the reasons I am filing for divorce is that, in the 3 years since he obtained his Green Card, he has refused to pursue any job other than driving a cab - a job that brings home only about $50 per day after gas. I will be taking ownership and financial responsibility for one of our cars, and he will take ownership & financial responsibility for the other. In order for him to do this, he's been told that he will have to get a bank loan, pay off the loan with the car dealership, which is in both our names, and then resume making payments to the bank. He has very little credit established, since everything has been in my name. I'm not sure a bank will make him a loan. I certainly cannot afford to take financial responsibility for two cars as well as a $13,000 credit card bill that he established without my knowledge. How can I avoid getting stuck with all of this debt?

The court will typically divide this debt between the parties if it was acquired during the course of the marriage. You may wish to come up with a plan where your playing it but your ex has to reimburse you for the amounts to be certain that the payments are being made.
