Legal Question in Family Law in California

My husband filed for divorce in CA end 2008, he moved out jan 2009 (date of separation). Aug temp custody and support orders were issued. Sept 09 we reconsiled and he moved back in. A few weeks ago he decided to move out again and I found out that I am pregnant. He still wants to proceed w/ divorce for financial reasons. Q: Since we reconsiled, will the court consider a new date of separation? Q: Can we finalize our MSA/ divorce since I am pregnant?

He should file an amended petition or you should file a response with the new date of separatiion and the new expected child. Your date of separation is the new date, after reconciliaiton and separation. It can be finalized at any time but should include the unborn child. Good Luck, Pat McCrary
