Legal Question in Family Law in California

My husband filed divorce papers on August 28th. He has yet to pay his filing fee. He served me the papers, but can he do that since he hasnt paid yet? Also, the paperwork I got says I have 30 days to respond, is that 30 days from the filing date on the paperwork or 30 days once he pays?

You have 30 days from the date on which you were served to file the response. Whether or not he has paid the court fees is between him and the court.
