Legal Question in Family Law in California

My husband said he filed for a divorce and that he can proceed without me. Is this true or do I need to be served with divorce papers?

You do need to be served the petition for divorce and the summons, however if you fail to file a response within the time allotted, he can proceed by way of default.

I agree with Ms. Kock. If it was a Joint Petition for Summary Dissolution, you would have to sign it, although he would not have to have you served. For a regular dissolution, he will have to have you served with the summons and petition.
