Legal Question in Family Law in California

My husband has the financial means to pay the mortgage on the house I am residing in while we are still married & going through divorce. He resides in our second property and is paying the mortgage and other related fees. We have been separated since February 2008. I paid the mortgage up until 4/09. He previously emptied out all joint accounts, leaving me with nothing. He refuses to pay the mortgage, it is in forclosure, we have approx. $200,000.00 equity, as of 1/09, the bank will own my home. Is he not legally responsible to pay this mortgage? Should I suggest selling the house? What if any recourse do I have.

You should have retained a lawyer when he first cleared out the bank accounts. I suggest you do so right away now.
