Legal Question in Family Law in California

Husband has friend staying in home

My daughter has filed for divorce. Her husband refuses to leave jointly rented residence even though he contributes nest to nothing to bills. He also has a friend staying there. Much of the household furnishings belong to me, her father. How do I protect my property? and How can my daughter get rid of the unwanted guest and husband?

Re: Husband has friend staying in home

She should retain an attorney to represent her. A restraining order can be obtained removing her husband from the residence. The court would not have jurisdiction over the friend unless he was served with a summons and complaint. However, she can probably call the police and have him arrested for trespass.

An order for child support order should also be obtained. If husband is unemployed, the court can issue an order for him to obtain employment, or can base child support on his ability to earn.
