Legal Question in Family Law in California

My husband is on my health insurance. We want to add his kids to my health insurance (I'm the step mother). My husband's ex wife wants to carry the kids on her own health insurance. She is demanding we pay for half of her health premiums while she carries the kids. Are we obligated to pay her?

I have never heard of a health care plan that would allow step children onto the step parent's coverage. Even if you can get it, though, ms. Kock is right, that you have to look at the current custody and support orders. It would be highly unlikely, though, that she would get an order that he pay half her premiums. First off, the premiums cover her too, and unless he is also paying spousal support she has no right to that. Second, medical insurance is one of the numbers plugged into the support calculation software as a deduction from income before support is allocated. So to then demand half would be double dipping. Only uninsured heath expenses are normally paid 50/50, not health insurance premiums.
