husband in jail recieved income tax check

lost rental home after husband jailed was our only source of income owed pastdue utility bills 2 months later recieved income tax check husband instructed me to pay moneys owed and use rest for rent and living exspenses ; utility bills,food , and for transportation to look for job had not worked for several years and had 7 year old daughter not related to husband . all money from tax returned spent . 12 months later filed for divorce 6 months later finalized now 4 months later exhusband files case against me for have of tax return money . do need lawyer ? can i win ? or will i have to pay?

You will need to account for the income tax return. Showing that it was used for payment of community property debts, and living expenses for yourself should result in on repayment.
