Legal Question in Family Law in California

My husband has been keeping his daughter more often. What used to be 65/35 is now 50/50. He and his ex-wife make comparable salaries, but HE alone provides health insurance for the child. If he goes back for child support adjustment, will the court be able to take my (husband's new spouse) income into account in California? We'd just like for it to be 50/50... NO CHILD SUPPORT - each parent takes care of their 50% responsibility.

While a new spouse income does not directly fit into a suppor equation, your tax filing as a married couple may slightly impact the numbers. Best to meet with an experienced family law attorney to explore the support calculation metrics.
