Legal Question in Family Law in California
My husband is keeping my two small children from me in CA I am in MD Help!!
My husband and I are recently seperated. I moved to MD where my family is, and he and my two children are in CA (and CA residents). He and I signed a document saying he would be moving here and relocating the children here with me, where we would share custody. Now he has refused to brong the children out here and stated I could see them when ever I want if I move back to CA. What can I do? How can I have my kids back?

You need to file an OSC here in California for custody or visitation.

Unfortunately you have set a precedent by agreeing, inadvertantly, that the children are safe and secure with their father and that for at least a time, it was in their best interest for them to be with him. But then he was not forthright with you was he. You both have some problems. Was your agreement made a court order, is so you are in a stronger position. I'm afraid you'll need an attorney on this one. Move away orders are difficult. He will need to go over all facts and issues with you to prepare your case for the judge. Don't delay, delay merely stabilizes the current situation. Good Luck, Pat McCrary

The first thing you need to do is to contact a CA attorney! I'm sorry that I am not licensed to practice there but you need to find an attorney that is.
