Legal Question in Family Law in California

My husband left the home March 29,2010 of his own accord. After just a short time in therapy with diagnosis made of passive agressive verbal abuse and has made it clear how close to physical abuse he truly was and borderline diagnosis he made the choice to live in denial. Now after several months now he has asked for his documents ie: ss card passport so forth. However, we have two boys 16,11 who live with me 100% of the time he randomly appears on Sundays for perhaps 2 hrs @ most to spend with them. I have also entered myself and the boys in therapy to help with the transition. Well he is asking for their documents as well birth certificates, passports even a copy of our marriage certificate. Neither of us have filed for divorce or legal separation I was let go from my employment -I worked for my husbands company control all the way. anyway what if any documents can or do I give to him regarding the boys, I do feel that he would and could be a flight risk.. thank you

You are not required to give him the children's documents absent a court order. As for your financial situation, you need to file a divorce or legal separation action so you can request child and spousal support orders. If you do not want to file an action yet, you can go to your local child support services agency and request they assist you in getting a child support order against your ex. This way you can get child support and do not have to file for divorce. Good Luck.
