Legal Question in Family Law in California

My husband and I were married in California 4 years ago. He is now in Brazil but I am still in California. Can I divorce him without him coming back or having to sign anything? There are no kids or property between us.

This answer should not replace the legal advice you should seek in an office consultation with an attorney skilled in California Family Law.

Your husband does not have to agree to terminate your marital status in a divorce. You can file the proper papers and have him served those papers in accordance with the laws of CA. If he does not file an answer, you can take his default.
