Legal Question in Family Law in California

My husband and I have been married for over ten years. We do not have children or any debts. We do have retirement assets, 2 cars, and own a home.

We meet residency requirements for the state of CA. How quickly can we get a divorce. I predict it will be contested.

The minimum amount of time to complete a dissolution of marriage would be 6 months and a day after respondent is served the petition

Ms. Kock is right about the statutory minimum. Without knowing what about the case might be contested, there is no way to even begin to guess how long it will take to deal with the contested issues. Bear in mind, however, that there is no way to contest the granting of a divorce itself. As long as one spouse declares there are irreconcilable differences the divorce must be granted as a matter of law. So the property distribution and/or spousal support would have to be contested for there to be anything to contest.
