Legal Question in Family Law in California

New husband in military

Hello, I share joint physical and legal custody with my child's father, we were never married. He has since disappeared from my child's life for about 3 years now. My husband now is in the military and if he gets stationed elsewhere what do I need to know or do so we can take my child with me? Thank you for any and all help.

You should obtain a judgment that gives you legal and physical custody of the child. That will give you the right to move with your husband. You will need to publish the summons if you do not have a paternity judgment and if you do you will need to ask the court for an order for substituted service. Good Luck, Pat McCrary

If there has already been a paternity petition filed, then move to terminate parental rights. Contact me directly.
