Legal Question in Family Law in California

My ex husband and I moved to California together. I have full custody of the children but he has been living with us for five years. Do I still have the right to move back to Oregon and take our children?

Although you do not specifically state it, I take it from your question that your custody orders are from Oregon. If so, you need to ask this question of Oregon attorneys, not California attorneys. Also, even if this was a California question, we would need more facts regarding the existing orders to be able to answer you. I expect Oregon attorneys would tell you the same thing.

Do you have a current custody order? Is it from Oregon or California? What does the current order permit? If moving to Oregon would be a return to the original order, then you can legally move back. However, if there have been interim orders, those would be controlling. Would need more information to advise further.
