Legal Question in Family Law in California

Husband moved out

My husband moved out and gave me back the keys. We are both on the title of the house. Now he wants to sell the property and take his half. Will the fact that he moved out help me at all in keeping the property? I have 2 children, my father died 2 weeks ago and my mother may die in the next 6 months. Will any of these issues help to prolong or prevent me from having to sell and move at this point in my life?

In a general sense, it takes both of you to sell the house, as you must both sign escrow papers. If your husband wants to force a sale by filing for divorce, it could take a long time before the house is ordered sold, depending upon your individual circumstances.

For a specific opinion regarding your individual circumstances, I suggest that you consult with an experienced family law lawyer. Experience is not expensive, it's priceless!
