My husband and I separated when I return to the marriage I found a insurance policy in his sister name . We have two children one is disable , If my husband was to past would I be able to Fight this in court.

No. The insurance policy proceeds go to whoever is listed as the beneficiary. If you're back together with your ex, maybe you can ask him to change the policy to list the children. If you're going through a divorce, you should request the Court order him to have an insurance policy that lists the kids as beneficiaries.
