Legal Question in Family Law in California
My husband won't show me the divorce settlement papers he drew up. I don't want to have to go to court or mediation for something that I may have agreed upon anyway. What are my options?
1 Answer from Attorneys
Did you use the "do your own divorce kit"? It is on the wall next to the "do your own heart surgery kit." I don't mean to seem so rude, but I strongly urge you not to sign this agreement until you have a copy of it, and have it reviewed by an independent attorney that you hire. Not his attorney. If you sign that agreement, you may give up valuable property rights, and the court has extremely limited authority to set aside later when you come to your senses and realize that you screwed up. Here are some of the stupid reasons that courts do not accept:
1.) I really love him and felt weak and was hoping that by signing everything over to him, he would abandon his love affair and come back to me, since I wasn't making an issue out of the money.
2.) I didn't want to/ couldn't afford an attorney. You would be surprised how cheap they can be to review and protect you from losing hundreds of thousands of dollars.
3.) I was under economic duress. I needed money bad, and figured the court would let me out of the thing later.
