Legal Question in Family Law in California

Does he own it all?

My Husband started his own business in 1987. That same year he baught two new Ford trucks in which he made payments on. In 1991 we were married. We made payments on the trucks for the first five years of our marriage. Everything is in his name only. Is everything considered his as he says, or am I half owner even though my name is not on paper?

Re: Does he own it all?

This is a fairly complex area of law. You might own as much as one-half, or you might own zero. A lot depends on what type of business it is: labor intensive or capital intensive. Also, is the business worth more now than at time of marriage. During the marriage, did he pull out sufficient funds to pay for his own labor contribution to the company (those funds would be community). Do not take his word for it; get an attorney.
