Legal Question in Family Law in California

Can my husband touch my inheritance? My parents gave me my inheritance in the Philippines. I have invested them in wealth funds and interest-bearing account all under my name. My husband and are permanent residents in California. I have dual citizenship, American, and Filipino and my husband is an American citizen. We have a bad marriage. My plan is to move to the Philippines when our 12 yr old son is in college.

In California, inheritance is separate property, which means there is no community interest. To best protect these assets, it is best to keep them in your name alone. Possibly, obtain a Judgment of Dissolution of Marriage (divorce) or Judgment of Legal Separation, then set up your Revocable Living Trust for those assets so they directly to your children if anything happens to you.
