It is not a prenup if you are already married. You need to talk to an attorney one on one.

You need to consult with an attorney knowledgeable in family law before you sign any marital agreement. You need to be informed of your rights to community property.

It is not a prenup if you are married. It would actually be a post-nuptial agreement. You have the right to speak to an independent attorney (not your husband's attorney) of your choosing.
