Husband wants Watts Credits

Disabled wife and their child has been living in the marital home. Husband wants to collect Watts credits. Initally half of the down payment for the home was the separate property of the wife. What is the chance of the husband collecting?

Re: Husband wants Watts Credits

First of all, an old and wise atty once told me "no body ever got Watts credits besides Mrs. Watts". It's true, it's a difficult reimbursement to get at court.

Secondly, the Wife's separate property investment is not relevant to Watts credits. She'll get her money back under F.C. 2640.

Lastly, there is not enough info to really respond. What is the reasonable rental value of the property? What are the expenses of keeping the property? How much support is being paid?
