Legal Question in Family Law in California
Ex husband and new wife refuse to comply with existing visitation orders and my 50% legal custody.. I have had police meet me at his home and try to get my 7 year old son but he takes him to another location until the police leave. He has been refusing my orders for a year. I have no way to afford an attorney and he has placed tracking devices, altered our orders on his PC to try to get certain info the court would jot allow him to have and threatened to withhold visitation and financial support ( which he did for over 9 months). He has slandered me, not allowed my son to have daily calls and changed my sons school with out my consent. The school had on file and knowledge of the orders and allowed the transfer. I am beginning to wonder how I will ever prevail if even the paper my orders were written on aren't worth anything. No one willnhelp BC I have no way to afford an attorney and my son is being emotionally anused . I have not even been allowed his bdsys, Xmas. Mothers day, any spring breaks or summer vacations. I can't emotionally take much more without my son in my life. I am holding on for a miracle. Of any he reading this can help me and jot just tell me to consult a lawyer, please reach out to me. I love my son. I can't explain the enormous hole in my world from him being withheld.
What can i do asap to get my son and keep him from being used as a way to hurt me .? I am going to the sheriff again today but they won't get involved. Mybex has family on the department so they just warm him if I try to get a civil assist and he removesbmy son until they leave.
1 Answer from Attorneys
You need to file a petition for an Order to Show Cause why he should not be found in contempt of court. That's not something for amateurs, and if your case is solid, you should be able to find an attorney who would work with you on the fees, including asking the court to order that he pay your attorney as part of the penalties for contempt. Whether you hire an attorney or go it alone, though, you have to get that petition filed.
