Legal Question in Family Law in California
My husband and his ex wife had temporary guardianship of a grandchild when they were divorced in 2000-2001. He was ordered to pay more child support than most dad's. However, the daughter has her act together now, married and has two other children. Grandmother will not give back the daughter, but grandfather needs financially (age64) to stop the child support. He is having health problems, and between the child support and her alimony, he is strapped for money all the time, while the ex wife can afford to go on lots of trips per year to Disneyland, Disneyworld, etc. The daughter is afraid to go after her mother for her child back, because she is finally allowing her to see her. My husband and I live 4 hours away, and are not even allowed to have Christmas visits without grandmother being there. He has joint custody. What can be done to get rid of the child support, since the mother and father of the child are both adults and capable of taking care of her?

This is not something that can really be discussed in a free Q&A forum. The generic answer is, you go back to court for a modification of support and possibly to terminate guardianship. Without reviewing the files and existing orders, however, that is really as detailed a response as is possible.
