Legal Question in Family Law in California

My husband has a 4 year old daughter for a previous relationship. We are filing for full custody and our court date is friday May 14,2010. My husband was served yesterday by his ex and the papers that she filed have false information. Is there consequences for falsifying information. She put that she has only 1 other child from another relationship when she really has two other kids. And it asks for the residence information in the past 5 years, she says they've lived in 2 different place, when really its been 8 different places including a motel. We live in california.

I would go to court and let the court know that she is perjuring herself. If the perjury is a material issue relevant to your case then it would be a good idea to address that issue with the court so that they know you dispute their recollection. Another good idea is to visit the self help center of your court to determine what may be helpful for your case. The local law library is a wealth of information for self help individuals.

For self represented individuals you can consult with the family law facilitator self help center at your local court house.

As always please consult a local attorney prior to taking legal action. Good luck. Also please check out my Santa Clara County Family Lawyer blog.
