Legal Question in Family Law in California
My husband has a 6 year old that he had before we got married, he has not seen her in about 4 years, his ex girlfriend just disappeared one day and left. My husband was currently in the Navy when he finish his 4 years he got served with child support and 1 year of unpaid child support, he has been paying support for almost two years and we heard from different people she lived in Texas then in L.A. he filed custody papers and none of them went through because we could not find he to serve her, she finally responded to an osc he filled that he had filed it in the wrong jurisdiction so the case didn't go no where. Her address was on the court papers so my husband sent letters and got no reply about 8 months ago a letter came back to him as undeliverable, the house that she lived went on foreclosure so they lost it ad is no longer living there. So we went back to step one, about 2 weeks ago he found her on facebook she replied and she has been calling him blocked for the past 3 days straight wanting to build a relationship with him and trust before they do anything. She says she is receiving the child support and she wants him to give up his rights, she has 2 other kids from her current boyfriend. but my husband wants to see what can he do about getting custody of his daughter. Can he do anything because the mother took her with no ones permission and know she is denying the dad from his daughter's right? Does he need to file here in California where she has born or in Louisiana where she lives?

Your husband should have hired a lawyer a LONG time ago. This has gone on too long and gotten too messed up for him to do anything but keep getting screwed out of his parental rights (not to mention support payments), unless he hires a lawyer. There is NO way you will get the help you need from an internet Q&A service.
