Legal Question in Family Law in California

My husband has a 13 year old son. We recently found text messages in his phone that his moms boyfriend is hitting her. Obviously this is happening in front of him too. We don't want him around her boyfriend. What should we do? Right now we have an equal custody agreement. It's getting close to the point where we're going to have to decide on a high school.

You should first consider whether or not you should contact Child Protective Services (CPS) to intervene. This kind of abusive behavior though directed at Mom is traumatizing to the child. Please also consider filing a request for order to change custody of the minor child in light of the information you provided.
