Legal Question in Family Law in California
My husband wants after 21 years of marriage a divorce. He also wants me to move out of our home in CA that we just bought a littleover 1 year ago. He is also wanting to close our credit card and is willing to give me an allowance. Over the last 21 years I have giving consistently up my employment in order to move with him and our children (now 19 and 14) due to his military career. Just last year I had to give up my very secure employment with a School District in VA, where I had worked for over 6 years and had great retirement and health insurance benefits to support his now civilian career in CA. I am working here as a Substitute in the School District and have been applying for over 30 jobs now all over the place but cannot even get an interview, even that I am highly qualified. He has changed bank accounts to his name only and keeps telling me to open my own account and credit card fully knowing I am a Homemaker with no steady income. What can I do to protect myself and my 14 year old.

Get to an attorney ASAP and get a divorce on file yourself, along with a motion for emergency temporary orders for spousal support, child custody, child support and sole occupancy of the family home.
It is important to meet with an attorney to discuss your legal options. Along with filing a petition for divorce, you can ask to set a hearing to deal with child custody ,child and spousal support attorney fees as well as the management of community accounts and credit. Part of the discovery process that can be instituted in your behalf will help capture information on the accounts you husband holds in his name alone and identify any other community and separate property.
