In a genaral sense, the better question is whether or not your husbands business interest is community property, separate property or both. It will depend upon the unique circumstances of how and when the interest was acquired. It could be his separate property and yet, at the same time, there could be a community property interest in the separate property. In other words, this is a complex area of law and one would need more specific facts before rendering an opinion.

For a specific opinion regarding your individual circumstances, I suggest that you consult with an experienced family law lawyer. Experience is not expensive, it's priceless!

Maybe. Such an issue requires more facts into the accounting of what exactly is separate and what is community property.

Re: husband's business

It depends upon when he acquired the first 50% of the business, and how he acquired the second 50% of the business. If it was through a will or inheritance it is seperate property.

Bottom line, you need to speak to a lawyer. You did not put in enough facts to answer this question.
