Legal Question in Family Law in California

Husbands Crazy Ex

My husband has three lovely children by his ex-wife. SHe has court ordered supervised visits, but refuses to see her children. The only calls she makes to our house are to annoy and harras my husband and I. SHe took us to court and didn't show up. Since the court orders were made she has not abided by them. The children want nothing to do with her. It has been 7 months since she has seen her children. They have become numb to their mother. I love them so much and hate what she has put them through over the years. My question is this, how long should my husband wait before he files against her for abandonment?

Re: Husbands Crazy Ex

You and your husband should discuss this matter with an attorney. Normally the court will not terminate parental rights unless there is a new party willing to step forward and take responsibility for the care of the child as a parent.
