Legal Question in Family Law in California

My husband's ex wife kicked out their son in January to live with us. We paid her child support for Jan/Feb/March and then tried to negotiate with her to not pay her April/May/June (half of June) as he is 18 and graduates from high school. She filed a motion to have his paycheck garnished and now we have to go to court 6/1 and are seeking a modification. I don't think we will ever get a dime back, why is the court system so in favor of the mothers? She made $90k last year but is lying that she did not and stated our son still lives with her. He has not spent one night at her house in 6 months!

Despite what you have experienced, the system is not made to favor anyone, other than the child. Unfortunately there are mothers who are very frustrated at dads who lie about their income as well. You may be able to ask for credit for those arrears, but I would suggest consulting with an attorney who can make the arguments for you, as they are complicated.
