Does an illegal alien (foreigner) have to file a divorce in ca?

1. Does an illegal alien(foreigner)/ 6 months expire F1(student visa) has a right to file a divorce against a her husband(in Philippines) here in Ca? No right?

2) Since she is an illegal alien if she file a divorce in Ca against her husband who is in the Philippines(not US Citizen), She can be deport immediately? right?

For my thesis research ''Asia Women are been fool by their own Asia Men who hold a US citizen in to sex to have Marry them which can't be under US law''.

If a person has lived, legally or illegally, in the State of California for 6 months, he/she can file for a divorce in California regardless of where the spouse resides. You would need to make sure that the other person is "served" properly in the Philipines.
