Illegal Audio Recording?

Is it illegal for me to record conversations between me and my husband when he's angry and yelling at me?

Can this be used in court?

Unless you have a court order allowing taping of these conversations they cannot be recorded without his consent. Pending obtaining a court order allowing the recording of these conversation, tell him that you are now recording the conversation and if does not consent to the recording of the conversation he should hang up. This will either end the conversation or you will have his permission to record the message. Be sure to have the tape recorder on when you make this statement.
