Illegal Divorce
My husband and I resided in California. I owned a sole and seperate property. My husband signed papers agreeing I was sole and seperate property owner and that he was also responisible for all debts together liens, 1st and 2nd's or loans that we had together We were married for 4 years. My husband commited adultry and was caught he then went to Nevada where he lied to the state saying that he lived in Nevada to get an ''illegal divorce. He lived in another state and his liscense and place of employment was not in Nevada. His mother passed away in 1991 and left us money, my sister in-law witnessed him signing my signature for the release of these funds. He also had a child in ElDorado County in 1991 and got married and owns property as in County Records. My husband got this divorce in 1993-94. I was never served with any divorce papers. I sold the house and payed all debts and loans we had together that I co-signed for. His wife now owns property and they own a house. She new about him lying to the State to get this divorce, have a child, and get married to her. Do I need to prove that I am illegally divorced in order to get this money? Do I need a Lawyer who practices Law in both CA. and NV?

If I thought that I could answer your question, I would certainly try. You have a very complex situation which needs to be discussed with a lawyer who can give you an idea of what an action would costs you and what benefit you would receive. You will start with a California lawyer, because that is where you lived during your marraige. His divorce decree is probably not valid, but you need to attack in promptly. Good Luck.
